Battery and mobility service from SUSHI Mobility GmbH

1. General

This battery and mobility service, limited to two (2) years, is a voluntary service provided by Sushi Mobility GmbH ("we" or "us") as the manufacturer of SUSHI BIKES. It grants the buyer of our products, in particular the buyer of a SUSHI BIKE ("you" or "your"), additional rights independent of the rights granted by consumer protection laws (see section 2). These statutory rights are not restricted by this battery and mobility service.

The services provided by this battery and mobility service are therefore intended to supplement and not replace the rights granted by German consumer protection laws.

As a consumer, you can choose whether you want to claim the service in accordance with this battery and mobility service or in accordance with your statutory consumer protection rights. However, the provisions of this battery and mobility service do not apply to claims based on statutory consumer protection rights.

2. Sushi products and German consumer protection laws

If a product is defective, you can in particular claim the rights under §§ 434 ff., §§ 474 ff. of the German Civil Code. This means that you can request repair, replacement, a price reduction or a refund of the purchase price from us free of charge for goods that are defective or do not correspond to the purchase contract. These rights are valid for two (2) years from receipt of delivery.

This battery and mobility service also applies to the batteries of SUSHI BIKES. It applies independently and in addition to your legal rights under German consumer protection laws.

If the battery you purchased from us is defective or does not correspond to the purchase contract, you can either make a claim in accordance with German consumer protection laws or this battery and mobility service.

3. Scope of the battery and mobility service

For a period of two (2) years from the delivery date of your SUSHI BIKES, you have the option of sending your SUSHI BIKES battery to us at your own expense to test its performance in the event of a loss of performance. Simply contact our customer service. As soon as we receive your battery, we will send you a replacement battery with a performance of at least 90%. There is a processing fee of EUR 19.00 for this, which we will refund in certain cases (see below). In any case, you keep the replacement battery and we keep the battery you sent to us in exchange.

We will refund your processing fee in the following cases:

  1. Your battery shows a performance loss of > 10% in the first twelve (12) months.
  2. Your battery shows a performance loss of > 30% from the 13th to the 24th month.
